Process
You can apply for a partner visa from inside Australia (subclasses 820 and 801) or from overseas (subclasses 309 and 100). When the first stage is approved, you receive a temporary partner visa that lets you live in Australia while the permanent stage is processed. During this time, you can work full-time or part-time.
The permanent stage is assessed about two years after you lodged your combined application, when you must show that your relationship is still genuine and continuing.
However, in some cases, you'll qualify for permanent residence even when the relationship with your spouse is over before the two years of the period. You become eligible for PR, if:
