Necessary Logs for filing E2 Visa Petition
The E-2 treaty investor visa is a non-immigrant visa for an entrepreneur or businessman who invests in a new or existing US business and develops and directs it. The holder can work only for that business. Its basic requirements are a substantial investment in a bona fide enterprise and the nationality of a treaty country. India is not an E-2 treaty country, so Indian nationals cannot qualify on their Indian nationality; some investors first acquire the citizenship of a treaty country, such as Grenada or Turkey, although E-2 eligibility is decided by the US consulate. The investor’s spouse and unmarried children under 21 can accompany them, and spouses can work in the US. E-2 status is granted for up to two years at a time and can be extended as long as the business qualifies, so you can run your own business in the US without a green card or citizenship.
Required Standard documents for US E2 visa application are as follows:
-
In the case of more than one candidate on a similar visa, a separate DS-160 form per applicant needs to be submitted.
-
A valid passport that will not expire for at least six months after your intended stay in the US.
-
Two standard passport-size photographs.
-
Evidence of your intention to leave the US when your E-2 status ends.
-
Proof of an income source.
Naturally, most of the application will consist of proof of the investment’s scope and value and of the US business itself. Every case is different, but the following documents are commonly used to prove that all requirements are met:
-
Business plan
-
Tax returns
-
IRS documentation
-
Business licenses
-
Contracts/Service agreements
-
Bank statements
-
Organizational charts and job descriptions
