Business Innovation and Investment Visa (subclass 188)
From 1 July 2012, Business Visa sub-classes (160,161,162,163,164,165) will be replaced by Subclass 188 To apply for it, you have to firstly meet the following basic requirements:
- Meet the 65 passing mark

- Below 55 years old
After fulfilling the captioned basic requirements, applicants can apply the visa through one of the following streams:
- Business Innovation Stream
- Investor Stream
For Business Innovation Stream applicants, you must have:
- A genuine and realistic commitment to be involved as an owner of a new or or existing business in Australia
- An overall successful business career
- Net business and personal assets of AUD$800,000
- A business turnover of AUD$500,000
Applicants may be eligible to renew the visa for an addition 2 years.
For Investor stream applicants, you must have:
- At least 3 years experience of direct involvement in eligible investment
- Made a designated investment of AUD$1.5 million into a state or territory government bond for 4 years
- Net business and personal assets of AUD$2.25 million

- At time of invitation, you must be less than 50 years of age

- 2.3 Nomination by a state or territory government; or sponsorship by an eligible relative in Australia

Visa holder entitlements:
- As a holder of this visa you are required to live and work in a Specified Regional Area in Australia
- As a holder of this visa your dependants can receive education in a Specified Regional Area in Australia
- This visa allows you and any family members included in your visa application to remain in Australia for up to four years
- You will obtain permanent residence after a certain period of time

Skilled – Recognised Graduate (Temporary) Visa (Subclass 476)
For Professionals and other Skilled MigrantsThis program is for people who are not sponsored by an employer but who have skills in particular occupations required in Australia. This visa allows recent graduates of selected overseas universities to gain up to 18 months of skilled work experience in occupations in demand in Australia. As a holder of this visa, you may apply for permanent residence at any time if you are able to meet the passmark on the General Skilled Migration points test.
Requirements :
- Under 50 years of age
- Have the skills and qualification that meet the Australian standard for an occupation on the Skilled Occupation List
- Meet the English language skill
This visa does not have a points test
Visa holder entitlements: This visa allows you and any secondary applicants (Partner, Child and Relatives) included in your visa application to remain in Australia for up to 18 months with no restrictions on work or study. During this period you may choose to:
- Travel
- Work
- Undertake further professional studies
- Study to improve your English skills
Prospective Marriage Visa (Subclass 300)
Partners and fiancés of Australian citizens, Australian permanent residents or eligible New Zealand citizens may apply to enter and/or remain permanently in Australia. This visa allows you to enter Australia and marry your intended fiancé within the visa's nine month validity period. Once married, holders of this visa can then apply to remain permanently in Australia.
Requirements:
- You have an Intent to marry
- You have an eligible sponsor (Partner) as an Australian Citizen / Australian permanent resident / Eligible New Zealand Citizen
- You must be aged 18 years or over
- You must be of the opposite sex to your intended spouse. Same-sex couples are not eligible for this visa
- You must have met (as adults) your intended spouse in person and know him or her personally
- You must have good health and character
- Visa holder entitlements
- With this visa, you:
- Must enter Australia before you marry your fiancé
- May leave and re-enter Australia as many times as you wish before your visa ceases (nine months after visa grant)
- Can work in Australia
- Can apply for a Partner visa in Australia after you marry your fiancé
- Can study, but you will not have access to government funding
- May use Australia's medical expenses and hospital care assistance scheme, Medicare, only if you are in Australia under this Visa
- Have skills, qualifications, experience and an employment background which match those required for the position
- Have demonstrated English language ability
- Be eligible for any relevant licences or registration required for the nominated position
- Have health insurance
Visa holder entitlements With this visa can employ overseas workers for a period of between one day and four years. With this visa those people employed from overseas can:
- Work in Australia for a period of between one day and four years
- Bring any eligible secondary applicants with them to Australia – secondary applicants can work and study
- After entering Australia, have no limit on the number of times they travel in and out of Australia

In all, there are 7 types of Australia student visa you can choose from depending on your circumstances. The study visa categories are listed as under:
- Schools Student Visa (Subclass 571) This visa applies if the student intends to study in a primary or secondary school, or is on a student exchange program.
- Vocation Education and Training Student Visa (Subclass 572). This visa applies where the student seeks to obtain a Diploma, Advanced Diploma or Certificate at a publicly funded Technical and Further Education College (TAFE) or through a private college.
- Higher Education Student Visa (Subclass 573) This applies to those seeking a tertiary qualification from a university, such as a Bachelor degree, Graduate Diploma or Graduate Certificate.
- Masters and Doctorate Student Visa (Subclass 574). For those seeking a postgraduate qualification, such as a Masters or Doctorate degree, this visa applies.
- Non-Award Foundation Student Visa (Subclass 575). This visa relates to study of a foundation course, ie. one that has no formal educational prerequisites, and one which will not lead to the award of a formal degree or diploma.
- AusAID or Defence Sponsored Student Visa (Subclass 576). This visa applies to students who have the support of AusAID or Australian Defence. It is a highly specialised visa category.
- Independent English Language Intensive Courses for Overseas Students (ELICOS) Student Visa (Subclass 570). This visa applies to those students intending to study only English. Students who are studying English as a prerequisite to other courses need to apply under the other visa subclass to which those courses relate.
- Guardian visa (Subclass 580). The Guardian Visa is part of Australia's provision for the welfare of overseas students who travel to Australia for education. The Guardian Visa allows a parent or other close family member to accompany a student or students while they undertake their Australian education, particularly the age group under 18 who are here to study at high school.
Restrictions on Student Visa
Once you arrive in Australia and commence your course of study, you will be required to comply with a number of visa conditions related to your attendance and academic performance.
Family Migration
Australia's family migration scheme is designed to allow people to migrate to Australia to join family members already living here as permanent residents or Australian citizens. A person who qualifies to migrate to Australia may include their family unit in their Visa. Normally the Australian relative must sign and lodge sponsorship papers with the Australian Government.
A person who falls within one of the degrees of relationship to an Australian citizen or permanent resident is not automatically eligible to migrate to Australia. Eligibility for preferential family visas are closely scrutinised and highly regulated. The classes of people eligible are narrowly defined.
For the 2006-2007 Family Migration program 6,619 family visas were refused (partners, fiancés, parents, relatives not including skilled and business). The obligations on sponsors can be heavy, too, as they can include the payment of substantial sums as bonds, which can be forfeited in certain circumstances - for example, if the visa holder relies on the Medicare or Social Security systems in Australia within the first two years of their arrival.
It is necessary to carefully examine each individual's circumstances in order to determine whether they are eligible to apply for a particular visa and their prospects of success in that application. Professional guidance is strongly recommended for this category.
Partner Category Visa OptionsPartners or fiancés of Australian citizens, Australian permanent residents or eligible New Zealand citizens may apply to enter and/or remain permanently in Australia. Partner category migration may apply to:
- People intending to get married (fiancés)
- Married (de jure) partners
- De facto partners (including those in a same-sex relationship)
If you are in Australia
Partner temporary visa (subclass 820) and permanent visa (subclass 801). For people to stay in Australia with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. If two years after you apply the relationship is ongoing, a permanent visa may be granted.
If you are outside Australia
Partners of Australian citizens, Australian permanent residents or eligible New Zealand citizens may apply to enter and/or remain permanently in Australia. Partners include:
- People intending to get married (fiancés)
- Married (de jure) partners
- De facto partners (including those in a same-sex relationship)
Partner Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100)
For people from overseas to enter and stay in Australia with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. If two years after you apply the relationship is ongoing, a permanent visa may be granted.
Prospective Marriage Visa (Subclass 300)
For people from overseas to enter Australia, before marrying their fiancé. Their fiancé must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Once married, holders of this visa can then apply to remain permanently in Australia.

Temporary CategoryTemporary visas refers to all visas that have a limited time of validity. In general, the screening for entry on a temporary visa is much less thorough than the screening for a permanent visa: the health checks are lessthorough, a Police Clearance certificate is not required and your ability to earn a living is not assessed.
